Trong thời đại toàn cầu hoá, việc hội nhập vào nền kinh tế chung của thế giới đòi hỏi các quốc gia phải mở rộng thị trường và liên kết với các quốc gia phát triển khác. Trong chiều hướng đó, cho tới nay, Việt Nam đã ký 12 hiệp định thương mại tự do (FTA) trong đó, đặc biệt có 2 FTA thế hệ mới:
- Ngày 8/3/2018, Việt Nam đã ký Hiệp định Đối tác Toàn diện và Tiến bộ xuyên Thái Bình Dương (CPTPP).
- Ngày 8/6/2020, Quốc Hội đã phê chuẩn Hiệp định Thương mại Tự do với Liên Âu (EVFTA).
Một trong những yêu cầu quan trọng trong cả hai FTA này là Việt Nam phải tôn trọng quyền của người lao động, đặc biệt quyền được thành lập tổ chức đại diện người lao động tại cơ sở (Nghiệp đoàn). Tổ chức đại diện người lao động là tổ chức được thành lập trên cơ sở tự nguyện của người lao động tại một đơn vị sử dụng lao động nhằm mục đích bảo vệ quyền và lợi ích hợp pháp, chính đáng của người lao động trong quan hệ lao động.
Thực tế cho thấy, chỉ những Nghiệp đoàn thật sự độc lập, không lệ thuộc bất cứ đảng phái nào, không bị doanh nghiệp nào chi phối mới dám đứng lên và tập trung vào việc đấu tranh bảo vệ quyền và lợi ích chính đáng của người lao động. Sự cạnh tranh giữa các tổ chức đại diện người lao động sẽ giúp người lao động và doanh nghiệp cùng được hưởng lợi ích kinh tế một cách công bằng.
Giám đốc Tổ chức Lao động Quốc tế (ILO) tại Việt Nam, Chang-Hee Lee đã nhận định: «Quyền nghiệp đoàn là quyền của người lao động, và nghiệp đoàn là tổ chức của người lao động, không chịu sự can thiệp của người sử dụng lao động. Cần có những thay đổi để tuân thủ các yêu cầu của Hiệp định CPTPP và EVFTA, và hơn hết là hoàn thành nghĩa vụ của Việt Nam với tư cách là quốc gia thành viên ILO».
Vì những nhu cầu cấp thiết kể trên, chúng tôi, Nghiệp đoàn Độc lập Việt Nam (NĐ ĐL VN) tuyên bố ra mắt cùng anh chị em công nhân, những người lao động cũng như những tổ chức nghiệp đoàn quốc tế.
Nghiệp đoàn Độc lập Việt Nam là một tổ chức gồm những người xuất thân từ nhiều ngành nghề khác nhau, với mục tiêu thành lập các Nghiệp đoàn tự do. Chúng tôi hy vọng sẽ đồng hành với Tổng Liên đoàn Lao động Việt Nam trong sứ mệnh bảo vệ quyền và lợi ích chính đáng của người lao động một cách hữu hiệu, nâng cao đời sống công nhân nhằm có được sự cạnh tranh công bằng giữa các doanh nghiệp đồng thời giúp cho người lao động Việt Nam được hưởng quyền lợi như ở các quốc gia khác trong CPTPP và EVFTA.
Chúng tôi cũng kêu gọi các công nhân trong các doanh nghiệp, những người lao động tự do trong các ngành nghề lao động khác cũng như những lao động trí thức hãy gia nhập đội ngũ Nghiệp đoàn Độc lập Việt Nam. Từng bước, NĐ ĐL VN sẽ hướng dẫn các bạn thành lập những Nghiệp đoàn cho ngành nghề của các bạn tại các cơ sở để chung tay bảo vệ quyền lợi thiết thực của chính các bạn.

OFFICIAL ANNOUNCEMENT OF VIETNAMESE INDEPENDENT UNION
To whom it may concern,
In this age of globalization and economic integration, countries are forced to boost their cooperation with others, particularly the developed nations. Vietnam is not an exception since the country has signed 12 FTAs in total, including the very two new ones: CPTPP and EVFTA, which have already been ratified at the national assembly.
Both CPTPP and EVFTA require the Vietnamese government to respect the legitimate rights and interests of its labors, especially the right of employees at grassroots level, on their voluntary basis to establish unions (or syndicates) representing themselves in the labor relations.
As a matter of fact, just the truly independent organizations which are not subjected to any corporations and political parties, can accomplish that lofty mission. Moreover, the competition of various unions definitely will bring no harms, but the fair interests to both employees and employers.
“Union right is an inalienable right of the employees. Thus, unions are the organizations representing them to defend their legitimate rights and interests, under no interference by the employers. Changes are needed for Vietnam to comply with the requirements of CPTPP and EVFTA, and most importantly to fulfill the country’s duty as a ILO member,” said Mr. Chang-Hee Lee, ILO Vietnam Director.
Because of that imperative practice, we solemnly declare the establishment of Vietnamese Independent Union (VIU) to all employees and international syndicates.
Though members of VIU are from various backgrounds, but all share the same purpose of forming free unions in different industries. We want to travel with the Vietnamese General Confederation of Labor (VGCL) as a supplementing force to protect the employees, guarantee their full interests as the fellows in other member states of CPTPP and EVFTA.
For those reasons, we call for the support and involvement of employees, free labors and intellectuals of all careers. Step by step, we will guide you to form the unions for your real interests.

In peacetime, due to her differences over the contemporary policies of Vietnamese authorities governing their behaviors in the bilateral relationship with People Republic of China (PRC), she has voluntarily become an ex-servicewomen before due date since 1994. Besides, Madame Binh is the daughter of the late Vietnamese ambassador to China and major general Nguyen Trong Vinh.

DECLARATION
Mesdames et Messieurs,
À l’ère de la mondialisation, l’intégration dans l’économie mondiale oblige les pays à élargir leurs marchés et à établir des liens avec d’autres pays développés. Dans cette tendance, le Vietnam a jusqu’à présent signé 12 accords de libre-échange (FTA) dont notamment deux de nouvelle génération:
– Le 8 mars 2018, le Vietnam a signé l’Accord Global et Progressif de Partenariat
Transpacifique (CPTPP)
– Le 8 juin 2020, l’Assemblée Nationale a approuvé l’Accord de libre-échange avec l’Union européenne (EVFTA).
L’une des exigences importantes des deux FTA est que le Vietnam doit respecter les droits des travailleurs, particulièrement le droit de créer une organisation les représentant au niveau local (syndicat). Cette organisation est établie par la volonté des travailleurs dans le but de protéger leurs droits et intérêts légitimes dans les relations avec leur employeur.
En fait, seuls les syndicats vraiment indépendants de tout parti politique, et non dominés par d’autres entreprises, osent se lever et se concentrer dans la lutte pour protéger les droits et intérêts légitimes des ouvriers. La concurrence entre les organisations représentatives des travailleurs aidera les ouvriers et les entreprises à bénéficier des mêmes avantages économiques d’une façon équitable.
Le Directeur de l’Organisation Internationale du Travail (OIT) au Vietnam, M. Chang-Hee Lee, a déclaré: «Le droit aux syndicats est un droit des travailleurs, et les syndicats sont des organisations de travailleurs, sans ingérence de l’employeur. Des changements sont nécessaires pour se conformer aux exigences du CPTPP et de l’EVFTA, et surtout pour remplir les obligations du Vietnam en tant qu’État membre de l’OIT ».
En raison des besoins urgents mentionnés ci-dessus, nous, Syndicat Indépendant Vietamien (VIU), annonçons notre présence parmi nos frères et sœurs, les travailleurs ainsi que les syndicats internationaux.
Le Syndicat Indépendant Vietnamien est une organisation des travailleurs de professions différentes, dont le seul but est de créer des syndicats libres. Nous esperons accompagner la Confédération Générale du Travail du Vietnam dans la mission de protéger efficacement les droits et les intérêts légitimes des travailleurs, d’améliorer leur vie afin d’assurer une concurrence loyale entre les entreprises, d’aider également les travailleurs vietnamiens à bénéficier des mêmes avantages que ceux des autres pays dans le cadre du CPTPP et de l’EVFTA.
Nous exhortons également les travailleurs des entreprises, les travailleurs indépendantsdes autres professions ainsi que les intellectuels à rejoindre l’Union vietnamienne des syndicats indépendants. Étape par étape, le Syndicat Indépendant Vietnamien vous guidera en formant des syndicats pour votre profession au niveau local pour protéger vos intérêts.

En raison des divergences sur la politique actuelle de l’État vietnamien envers la Chine, elle a été démobilisée en 1994. Mme Nguyen Nguyen Binh est la fille du général Nguyen Trong Vinh.
